Overview
Welcome to Cortaire! The terms "we", "us" and "our" refer to Cortaire. Cortaire operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Cortaire is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 - Access and Account
By agreeing to these Terms of Service, you represent that you are at least 18 years old, or that you have your parent or guardian's permission to use the Services, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
Section 2 - Our Products
We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer, on a case-by-case basis. This does not affect the rights of any customer whose order has already been accepted.
Section 3 - Orders
When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance by email. We must receive and process your payment before your order is accepted.
Cortaire reserves the right to decline an order, for example due to a pricing or listing error, stock unavailability, or suspected fraud. If we decline or cancel an order, you will be notified by email and receive a full refund of any payment already taken.
Section 4 - Your Right to Cancel
As a consumer, under the Consumer Contracts Regulations 2013 you have a legal right to cancel your order within 14 days of receiving your goods, without giving a reason.
To cancel, simply contact us at hello@cortaire.co.uk within 14 days of delivery. Once you've told us you wish to cancel, you have a further 14 days to return the goods to us. We will refund you within 14 days of receiving the returned goods, using your original payment method. You are responsible for return postage costs unless the item is faulty, damaged, or not as described.
This legal cancellation right sits alongside, and does not replace, our separate Returns Policy, which sets out our own return process.
Section 5 - Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Prices include UK VAT where applicable. Delivery charges are shown separately at checkout before you complete your order.
We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. Where there is a conflict between promotion terms and these Terms, the promotion terms will govern for that promotion.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store, and to promptly update your information, including your email address and payment details, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) any payment information you provide is true, correct, and complete, (ii) you are duly authorised to use the payment method for the purchase, and (iii) you will pay all charges incurred at the posted prices, including delivery charges and applicable taxes.
Section 6 - Shipping and Delivery
Delivery timeframes and shipping information are set out in our Shipping Policy. Goods will be delivered within 30 days of order confirmation, in line with the Consumer Contracts Regulations 2013, unless a longer timeframe is agreed with you.
We are not responsible for delays caused by circumstances outside our reasonable control, such as carrier delays or extreme weather. If delivery is delayed for reasons within our control, you may be entitled to a refund in accordance with your statutory rights.
Section 7 - Faulty, Damaged, or Misdescribed Goods
If your order arrives faulty, damaged, or not as described, please contact us as soon as possible at hello@cortaire.co.uk with photos and your order number. Under the Consumer Rights Act 2015, you may be entitled to a repair, replacement, price reduction, or refund. Nothing in these Terms limits or excludes these statutory rights.
Section 8 - Intellectual Property
Our Services, including all trademarks, brand names, text, displays, images, graphics, product designs, video, and audio, and the design, selection, and arrangement thereof, are owned by Cortaire, its affiliates or licensors and are protected by UK and international copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent. Except as expressly stated, nothing in these Terms grants any licence or other rights to you under any patent, trademark, copyright, or other intellectual property of Cortaire, Shopify, or any third party.
Cortaire's names, logos, product names (including AireTech), designs, and slogans are trademarks of Cortaire. You must not use these without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services are the trademarks of their respective owners.
Section 9 - Optional Tools
You may be provided with access to tools offered by third parties as part of the Services, which we do not monitor or control. We provide access to such tools "as is" and "as available" without any warranties or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is at your own risk, and you should review the relevant third party's own terms.

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you choose to access third-party sites, you do so at your own risk, and any complaints or questions about third-party products or services should be directed to that third party.
Section 11 - Relationship with Shopify
Cortaire is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Cortaire. Shopify is not responsible for any aspect of the sale between you and Cortaire, including any injury, damage, or loss resulting from purchased products.
Section 12 - Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy, which you can view here [LINK]. Because the Services are hosted by Shopify, Shopify also processes personal information about your access to and use of the Services. Please review our Privacy Policy for details of how we, Shopify, and our partners use your personal information.
Section 13 - Feedback
If you submit any ideas, suggestions, feedback, or reviews ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, publish, and display that Feedback for any purpose, including commercial use. You confirm that you own or have the rights to any Feedback you submit, and that it does not infringe any third party's rights or contain unlawful, defamatory, or obscene material.
We are under no obligation to keep Feedback confidential, pay for it, or respond to it. We may, but are not obliged to, monitor or remove Feedback we consider unlawful, offensive, or in breach of these Terms.
Section 14 - Errors, Inaccuracies and Omissions
Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any such errors and to update information at any time. If an error affects an order you've already placed, we will contact you before proceeding and you'll have the option to cancel for a full refund.

You may access and use the Services for lawful purposes only. You must not use the Services: to break any UK law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any other person or entity; or to engage in any conduct that restricts or inhibits others' use of the Services or that may harm Cortaire or its users.
You also agree not to upload viruses or malicious code, reproduce or resell any part of the Services without permission, collect other users' personal information, or attempt to circumvent the security of the Services. We reserve the right to suspend or terminate your account if you breach these Terms.
Section 16 - Termination
We may terminate this agreement or your access to the Services at any time if you materially breach these Terms, and you will remain liable for any amounts already due. Provisions which by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and this clause — will continue to apply.

The information presented on the Services is provided for general information purposes. While we take care to keep it accurate, we do not guarantee its completeness or accuracy, and any reliance you place on it is at your own risk.
Except as expressly stated by Cortaire or required by law, the Services are provided "as is" and "as available". This does not affect or limit any statutory rights you have as a consumer under the Consumer Rights Act 2015, including your rights relating to goods being of satisfactory quality, fit for purpose, and as described.
Section 18 - Limitation of Liability
To the fullest extent permitted by law, Cortaire will not be liable to you for any indirect or consequential loss (such as loss of profits or loss of data) arising from your use of the Services or your purchase of our products.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law. Nothing in these Terms affects your statutory rights as a consumer.
Section 19 - Indemnification
You agree to indemnify and hold harmless Cortaire, Shopify, and our respective affiliates, officers, and employees from any losses, damages, or claims (including reasonable legal costs) arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services. This does not apply to losses arising from our own negligence or breach of these Terms.
Section 20 - Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be considered severed from these Terms and will not affect the validity or enforceability of the remaining provisions.
Section 21 - Waiver; Entire Agreement
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with any policies referenced within them, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications.
Section 22 - Assignment
You may not transfer or assign these Terms or any of your rights under them without our prior written consent. We may transfer or assign these Terms, including to a successor of our business, without affecting your rights under them.
Section 23 - Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
Section 24 - Complaints and Alternative Dispute Resolution
If you have a complaint, please contact us first at hello@cortaire.co.uk so we can try to resolve it directly. If we're unable to resolve matters between us, you may be entitled to refer your complaint to an approved Alternative Dispute Resolution (ADR) provider. The headings used in these Terms are included for convenience only and do not affect the interpretation of these Terms.
Section 26 - Changes to These Terms
We may update these Terms from time to time to reflect changes in our business or the law. The current version will always be available on this page. Your continued use of the Services after any changes are posted constitutes acceptance of those changes, though this will not affect orders already placed under a previous version of these Terms.
